Protect Workers’ Right to a Private Ballot

Oppose H.R. 800

Senate Vote - Tuesday, June 26!

Senator Ted Kennedy (D-MA) has introduced the misnamed “Employee Free Choice Act”, which would outlaw secret ballot elections for employees in union organizing campaigns. A Senate vote on H.R. 800 will occur on Tuesday, June 26.

H.R. 800 would create a dangerous shortcut by eliminating secret ballot union elections in the workplace. Instead, a union would be recognized if it simply obtained authorization cards signed by a majority of employees in a business that the union is attempting to organize. Unions want this shortcut, which is known as “card check,” because they will get to oversee the process – not the federal government – and employees are forced to make their choice in front of their employer, the union organizers and their co-workers.

There are many examples where the union card check process has been challenged on the basis of coercion, misrepresentation, forgery, fraud, peer pressure and promised benefits. Labor leaders have indicated that they plan to aggressively pursue union organizing campaigns in retail workplaces if H.R. 800 becomes law.

• For over sixty years, the choice about whether to join a union has been made by employees voting in a private, federally-supervised secret ballot election.
  
• The secret ballot election is the fairest way to guarantee the rights of employees to freely choose whether or not to be represented by a union. It allows for a private, confidential vote by employees, based on the principles of the American system of democracy.
